Common questions
Can bail be filed on a Sunday or a court holiday?
On holidays, a duty Magistrate hears remand and urgent matters at the district courts. Regular bail applications are usually heard on working days, but an application can be prepared and kept ready so it is filed on the first working day.
How soon is a bail application heard?
At the Magistrate and Sessions courts, the court usually calls for a reply from the investigating officer and lists the matter within a few days. In the High Court, the State is served in advance and the matter is listed before the bench handling bail. Exact timing depends on the court and the case.
Who needs to come to court?
The family usually needs to bring the surety and documents once bail is granted. Until then, most work can be done with copies of the documents, sent on WhatsApp.
We live outside Delhi. Can you help?
